Terms And Conditions

These terms and conditions (“Agreement”) govern the use of the travel booking website www.bookmydarshan.in (“Website”), which is owned and operated by PilgrimPathways Tourism Pvt Ltd. (“Company”), in collaboration with several Third Party Operators including but not limited to the Andhra Pradesh Tourism Development Corporation (APTDC), as a co branding partner.

This is a legal agreement between any person who visits the Website, enquires about the Pilgrim Packages, purchases the Pilgrim Packages through the Website (“Customer”). The Customer hereby irrevocably and unconditionally agrees and acknowledges to be governed by this Agreement.

This Agreement (and its modifications / revisions) as available on the Website shall also mean and include the specific details, terms & conditions, inclusions and exclusions as applicable on and as mentioned under each specific Pilgrim Package. The Customer agrees that in the event of any conflict between the specific terms of each Pilgrim Package and the general terms under this Agreement, to the extent permitted by Applicable Law, the specific terms of the Pilgrim Package shall prevail.

Accordingly, the Customer shall also refer to the specific terms and conditions of the Pilgrim Packages as such specific terms and conditions shall also be binding on the Customer.

Company’s Role

The Company hereby represents to the Customer that the Company and the Website are merely providing an online platform which enables the Customer to access, view and book certain Pilgrim Packages operated and run by Third Party Operators. The Company also acts as an aggregator and curator for the Pilgrim Package i.e. the Company merely creates and facilitates a Pilgrim Package by assembling various services provided by various Third Party Operators and such services include (without limitation) Temple tickets, special darshan tickets, transportation services, food and refreshments services, accommodation services, guided tours and poojas / sevas (“Services”).

In no event does the Company itself operate or offer the Pilgrim Package and / or any mode of transportation, accommodation, lodging, Pilgrimage tickets and / or tourist tours / trips. The Customer hereby agrees and acknowledges that by engaging the Services, the Customer is deemed to enter into separate contractual relationships / agreements with the specific Third Party Operators.

The Company shall have no other relationship with the Third Party Operators except for the contractual relationship expressed by the provisions of this Agreement. At no time will the Company be construed to be an agent, representative, partner or joint venturer of any Third Party Operator.

Any of the Pilgrim Packages displayed on the Website is solely based on the information provided or updated by the Third Party Operator regarding the availability of such Pilgrim Package. Any services including amenities, services, routes, fares, nature of Temple ticket, schedule, bus type, train type, flight type, vehicle type, seat availability, nature of the seat and any other details pertaining to the Pilgrim Package are provided directly by the respective Third Party Operator.

In no event shall the Company be held liable for the information provided by the Third Party Operator. The Company will not be liable for any claims or damages resulting from any incorrect or misleading information shared by the Third Party Operator.

Definitions and Interpretation

In this Agreement, unless the context otherwise requires, the following expressions shall have the following meanings:

“Agreement” shall mean these terms and conditions and shall include the specific terms and conditions applicable to each Pilgrim Package (including any modifications, revisions).

“Applicable Law(s)” means all laws, rules, guidelines, statutes, including the bye laws, rules, regulations, orders, ordinances, protocols, codes, guidelines, policies, notices, directions, judgments, decrees and / or other requirements or official directives of any Governmental Authority or any person acting under the authority of any Governmental Authority and / or any religious and / or holy site, including any statutory authority in India and / or any right or remedy available in equity or otherwise, whether at central, state or local level.

“Business Day” shall mean a day other than a public holiday in India when banks in India are open for business.

“Company” shall mean PilgrimPathways Tourism Pvt. Ltd.

“Confidential Information” means all information relating to the Website, Services and / or Pilgrim Package becomes aware in its capacity as, or for the purpose of becoming, a Customer in whatever form, and includes information given orally and any document, electronic file or any other way of representing or recording information which contains or is derived or copied from such information but excludes information that:

  • (a) is or becomes public information and is identified in writing at the time of delivery as non confidential by any Representative of the Company;
  • (b) is known by the Customer before the date the information is disclosed to it;
  • (c) is lawfully obtained by the Customer after that date, from a public source.

“Customer” shall mean the person or firm who avails the Services from the Company, who has completed the age of eighteen (18) years at the time of making bookings in accordance with the payment terms set out in this Agreement.

“Customer Data” shall mean:

  • the data provided by the Customer for the purpose of availing the Services; and
  • any and all information, whether as such actively or directly provided by the Customer or passively generated by the Website and Company.

“Data Protection Legislation” shall mean any legislation in force and as amended from time to time relating to privacy and / or the processing of personal data under the Applicable Laws of India.

“Force Majeure Event” means any of the following events or combination of such events, and which are unforeseen in nature and beyond the reasonable control of the affected Party, and not caused / occasioned due to acts or omissions by such Party:

  • war (whether declared or undeclared), civil war, invasion, armed conflict or act of foreign army, embargo, insurrection, terrorist or military action; or
  • acts of God, like fire, lightning, drought, flood, typhoon, tornado, landslide, cyclone, hurricane, avalanche, tempest, storm, earthquake, epidemics and pandemics or any natural disaster; or
  • acts, events, omissions or accidents beyond the Company or Third Party Operators’ reasonable control such as but not limited to pandemics, quarantines, border closures, acts of governments or authorities, wars, hostilities, political uprisings, or civil disturbances, riots, strikes, terrorist activities, or the threat of terrorist activities, criminal acts committed by third parties, defects of vehicles or breakdown in equipment.

“Governmental Authority” shall mean any government or quasi government authority, statutory authority, government department, agency, corporation, commission, board, tribunal or judicial or quasi judicial body, or other law, rule or regulation making entity having or purporting to have jurisdiction on behalf of the Republic of India or any state or other subdivision thereof or any municipality, district or other subdivision thereof, including the collectorate, town planning / development authority, gram panchayat, municipal / local authority, Labour commissioner.

“Pilgrim Package” shall mean a package / trip / tour / Pilgrimage / journey operated by one or more Third Party Operators as displayed on the Website including a customized package, package curated and aggregated by the Company in its sole discretion.

“Privacy Policy” shall mean the privacy policy of the Company and Website that can be found at www.bookmydarshan.in/info/privacy-policy

“Representatives” means a party’s officers, employees, managers, directors, agents, contractors, advisors, consultants and affiliates.

“Tax” means any tax levy, impost, duty or other charge or withholding of a similar nature imposed by any Governmental Authority (including GST and any penalty or interest payable in connection with any failure to pay or any delay in paying any of the same).

“Third Party Operator” shall mean and include an independent third party operator, facilitator or operator which includes without any limitation any airlines, hotels, restaurants, bus operators etc., Temple trusts, religious societies, railway authority, vehicle operators, Governmental Authority providing public transport services (as listed on the Website).

“Website” shall mean www.bookmydarshan.in and any other websites, apps or other services managed and utilized by the Company to offer the Services and Pilgrim Packages.

Eligibility

The Customer hereby represents and warrants to the Company that he / she is at least eighteen (18) years of age and is competent under the Applicable Law and possesses the legal authority to enter into an agreement (including this Agreement).

To register with the Website or make a Reservation, the Customer must have completed the age of eighteen (18) years. In the case of a minor, the minor must be accompanied by an adult who shall be jointly or individually responsible for the supervision, wellbeing and monitoring of the minor.

In the event that the Company discovers that the Customer does not meet the above eligibility criteria, the Company reserves the sole right to terminate the Customer’s membership, any bookings, Reservations and / or block access to the Website.

Bookings and Reservations

The Website offers the Customer the ability to search for the specific Pilgrim Package that he / she wishes to book utilizing the filters provided on the Website.

Upon booking a Pilgrim Package of his / her choice, the Customer hereby agrees to pay all charges for their booking including the Pilgrim Package price, applicable fees, service fee, offline fees, Taxes, and any other items identified during checkout (collectively, “Total Price”).

The booking shall be completed only once:

  • (a) the Customer books a Pilgrim Package on the Company’s Website;
  • (b) the Customer accepts and agrees to all the terms and conditions presented in this Agreement;
  • (c) the Customer accepts and agrees to the specific terms and conditions of such Pilgrim Package;
  • (d) the Company or its designated third-party payment gateway provider (whichever is earlier) receives a legitimate payment into its designated bank account; and
  • (e) all information supplied by the Customer for the purposes of that booking are true, accurate, current, and complete to the best of the Customer’s knowledge.

Upon successful payment and confirmation of a booking, the Company shall send the Customer (by email) the booking confirmation to the email address specified by the Customer within two (2) hours (“Reservation”). The Customer hereby agrees that the aforementioned timeframe is merely indicative in nature and is not absolutely binding. The Company will undertake reasonable endeavors on a best-efforts basis to ensure the delivery of the Reservation within the timelines mentioned above.

The Customer hereby unconditionally and irrevocably acknowledges that the failure to provide a valid and accurate email address shall not constitute a delay on the part of the Company, and any discrepancies or issues arising from inaccuracies in the provided email address shall be deemed the responsibility of the Customer. The Company reserves the sole right to revise and alter the timeframe specified hereinabove. In the event the Customer does not receive the Reservation for any reason whatsoever, the Customer is requested to contact the customer care helpline for assistance.

By receiving the Reservation, the Customer agrees and acknowledges that the Customer shall be subject to, and responsible for complying with, all terms of the Reservation, including without limitation, the specific terms of the Third Party Operators lodging, accommodation, transportation and the Temple policies.

Payment

The Customer will be invoiced for the Total Price on the invoice which shall be payable. Any prices / charges displayed on the Website are inclusive of GST (where applicable).

Payment must be made in INR (Indian Rupees) on the payment platform on the Company’s website (“Payment Platform”). Payments should be made to the Company using the Payment Platform which offers a number of payment options including:

  • (i) credit card or debit card or net banking;
  • (ii) UPI;
  • (iii) any other RBI approved payment method at the time of booking.

Payment processing for bookings is facilitated by NTT Data Systems (Atom). The Company does not maintain records of financial instruments such as Credit Cards, Debit Cards, Net Banking, UPI, or others. Payment information is securely processed by NTT Data Systems (Atom).

In the event that the Customer does not receive the Reservation within two (2) hours after making the payment, the Customer is required to reach out to the customer care helpline for assistance.

In the event that the payment has failed due to any reason whatsoever, the Customer will be required to redo the booking process.

In the event the Customer’s bank account has been debited for the booking, but the Payment Platform has failed to receive such funds due to the default of the Customer’s bank, the Customer shall be required to contact their respective bank, UPI provider and / or payment service provider for the refund. In no event shall the Company be held liable or responsible for such refund. The Customer may also reach out to our customer care and Payment Platform for any assistance on this matter. However, such assistance will be provided on a best effort basis.

The Customer hereby agrees and acknowledges that the Company shall not provide an alternate booking, refund and / or Reservation for any of the reasons mentioned above.

Right of Refusal

The Company reserves all its rights to refuse or cancel a Reservation, if the Company notices something unusual about a Reservation and / or if the Customer fails to provide the Company with complete or correct details for availing the Services.

Notwithstanding the above, the Company reserves the right to immediately suspend or terminate a Customer’s registration or deny access to the Website under the following circumstances:

  • The Customer violates the terms of this Agreement;
  • The Company cannot verify or authenticate the information provided by the Customer; and
  • The Company believes that the Customer’s actions may infringe on third party rights, violate any Applicable Law, or lead to liability for the Customer, other Customers, or the Company or its Representatives.

Upon suspension or termination, the Customer is prohibited from attempting to register with different credentials or using the Website until reinstated at the sole discretion of the Company.

Right of Refusal by Third Party Operator

The Customer hereby unconditionally and irrevocably agrees that the Third Party Operator may refuse to provide the whole or part of the service(s) relating to the Pilgrim Package, agreed to be provided to the Customer, for any booking or Reservation made through the Website with or without assigning any reasons.

This refusal may occur due to various factors, including but not limited to behavioral issues, concerns related to public safety, health risks, infectious diseases, government orders or notifications, etc.

In such instances, any resulting liability shall be the sole responsibility of the Third Party Operator, as it falls outside the scope of the Company.

Cancellations, Travel Issues, Refunds and Booking Modifications

By receiving a Reservation, the Customer hereby agrees that for every Pilgrim Package, the cancellation and refund policy shall vary. The specific details mentioned under the Pilgrim Package shall be the relevant binding and governing rules for such Pilgrim Package.

The refund policy may differ for each Pilgrim Package based on the distance, accommodation etc., offered by the Third Party Operator. The Customer hereby agrees to be bound by the refund terms as set out under the Pilgrim Package and their Reservation.

The Website provides the Customer with the option to carry out modifications to the reservation (“Reservation Modification(s)”). Any Reservation Modification(s) are the sole responsibility of the Customer, and the Customer shall be liable for any changes they make, including applicable surcharges, additional fees, or Taxes.

All modifications are subject to availability as determined by the Third Party Operator. The Company shall in no event be liable for the failure to process Reservation Modification(s). If successful, the Customer shall receive a revised Reservation.

Notwithstanding any provision in this Agreement, the Third Party Operator reserves the right to cancel or reschedule any Pilgrim Package and / or Reservation due to insufficient demand, unsafe conditions, Force Majeure Events, or other reasonable causes. The Company will notify the Customer and the Third Party Operator may offer alternate travel dates or a full refund.

Cancellation by the Customer

The Customer may cancel the Reservation on the Website. The Customer acknowledges that:

  • Cancellation is subject to the terms and conditions mentioned in the Pilgrim Package.
  • Refunds will be determined by the Company based on timing, demand, and distance of the Pilgrim Package.
  • Temple / Darshan / Pilgrimage tickets are non-refundable unless explicitly permitted by the Third Party Operator, in which case the Company may process a refund at its discretion.

Cancellation by the Third Party Operator / Company

If part or all of the Pilgrim Package (e.g., tour, journey, food, accommodation) is cancelled by the Third Party Operator or Company, a partial refund of the Total Price may be initiated based on the investigation conducted by the Company.

Refunds will depend on the circumstances and input from both the Third Party Operator and the Customer. Temple / Darshan / Pilgrimage tickets are non-refundable unless a refund is allowed by the Third Party Operator. In such cases, the Company may, at its discretion, process a refund.

The Company is not liable for any incidental or consequential losses (direct or indirect) incurred due to a cancelled Reservation, including but not limited to loss of earnings, enjoyment, accommodation, transport, or dependent services.

Third Party Advertisers

The Website may include links and hyperlinks to websites operated by third parties. The Company represents that it does not have control over such third party websites and disclaims any responsibility for their content. If a Customer chooses to visit any third party website, it will entirely be at their own risk, and the Company holds no liability in connection with such actions.

The Company shall not be held liable or responsible for any inaccuracies, omissions, or representations or misinformation displayed or provided by such third party websites. The Customers are urged to verify the accuracy of all information presented on third party websites.

Customer Liability and Responsibilities

The Customer is advised to conform to the details mentioned under the Reservation and shall be responsible for communicating with the Third Party Operator to clarify, determine and reverify the Reservation or any information related to the Pilgrim Package.

The Customer shall at all times carry a digital or paper copy of the Reservation and shall cooperate with the Third Party Operators and any Governmental Authority to furnish a copy of the Reservation and/or valid identity proof such as Aadhaar card, passport, PAN card, or voter identification card.

The Customer is responsible for their own acts and omissions, as well as those of their co-passengers (in a joint booking).

In no event will the Company or the Third Party Operators be liable for any damage caused to the Customer, public property, private property and/or third party damages.

The Customer understands that the Pilgrim Package includes visits to religious places which may have codes of conduct and/or guidelines. The Customer agrees to follow these guidelines strictly. The Company is not liable for any noncompliance that leads to denial of entry or dismissal from religious sites. These codes are subject to change.

The Customer agrees to act with integrity, respect others, and comply with applicable laws. If the Customer is a minor or accompanying one, the parent/guardian is solely responsible for the minor’s supervision.

The Customer is advised to thoroughly verify the description of services in each Pilgrim Package before booking.

The Customer agrees to use the website in compliance with all applicable laws and this Agreement.

The Customer is responsible for maintaining confidentiality of their account credentials including username, OTPs, and passwords. The Company will never request such credentials.

The Customer agrees not to harm, interfere with, or disrupt the Website’s operations.

The Customer assumes all risks involved in the Pilgrim Package, including travel, illness, injury, or death, and acknowledges their personal responsibility in assessing such risks.

Travel involves inherent health and safety risks. Hygiene, accommodation, and transport standards may be lower in some destinations, which could result in risks such as food poisoning, disease, or injury.

Content

The Company may display various content on the Website including audio, images, software, text, icons, etc. ("Content").

All content, materials, and intellectual property related to the Website are the exclusive property of the Company or its partners, affiliates, or licensors, and are protected under applicable laws.

Trademarks, logos, brand names, and proprietary information of Third Party Operators belong to their respective owners and are similarly protected.

The Website does not grant any license or rights to use third-party logos, trademarks, or service marks in any form.

Content displayed is for representation purposes only and may not reflect actual services.

Some content may pertain to faith, spirituality, mythology, cultures, and historical figures. This content is for educational purposes only and is not intended to be factual or authoritative.

The Company does not intend to offend any individual or group. Any unauthorized use of content or trademarks may lead to legal action.

Content is sourced from public domains and is provided for general knowledge and reference.

By using the Website, the Customer acknowledges and agrees to these terms regarding the Content.

Intellectual Property Rights

All intellectual property rights in or arising out of or in connection with the Services or the Website shall be owned by the Company or its partners or affiliates. No reproductions, scans or copies (wholly or in part) shall be made without prior written consent of the Company. Breach of this clause may lead to immediate termination of the Reservation and user account, and the Company reserves the right to recover costs, damages, attorney costs and interests.

The Customer is not allowed to store, print, or display the Content. Use of any part of the Website including but not limited to text, images, trademarks, and logos for commercial purposes is prohibited without express written permission.

Website and Registration

Upon entering a valid OTP during the first booking transaction, an account is automatically created on the Website. All bookings, modifications, and cancellations are tied to the Customer’s registered mobile number.

To register, the Customer must provide:

  • Full name
  • Age
  • Government IDs
  • Contact details (email and phone number)
  • Billing information (bank details, card info, or UPI)

The Customer represents that all provided information is true and accurate and agrees to update it as necessary. The Company is not liable for any failure to do so.

If account credentials are lost or stolen, the Customer must notify the Company immediately. The Company is not liable for the Customer’s activities on the account.

The Company reserves the right to terminate access to the Website and Services at any time without notice for maintenance or other reasons. The Website may be improved or modified at the Company's discretion.

Customers agree to use the Services for personal use only and not for competitive commercial purposes.

Mobile numbers are used for OTP-based authentication during account creation and reservations.

Personal Data

The Customer’s personal data usage is governed by the Privacy Policy. By accessing the Website, the Customer agrees to its terms.

The Customer owns all rights to their data but grants the Company an irrevocable, unlimited, royalty-free license to use it. Each party agrees to comply with data protection laws and the Company’s Privacy Policy.

The Customer agrees that the Company may use their social media content (“User Generated Content” or “UGC”) on its Website or official social media pages. The Company reserves the right to edit or adapt the UGC. The Customer may request removal of such content, which will be honored on platforms under the Company’s control. No monetary compensation is provided for UGC use.

Communications

Unless stated otherwise, all notices or communications will be sent electronically via email, messaging, calls, or other available methods.

Customers authorize the Company’s representatives to contact them via phone, message, or email.

Company Disclaimers

The Company does not endorse or guarantee the performance, safety, legality, or quality of any Pilgrim Package or Third Party Operator.

While the Company strives to provide accurate information and booking support, it is not responsible for service availability or quality. No advice or communication from the Company will create a warranty unless explicitly stated.

All rights and liabilities are limited to the scope of this Agreement.

Limitation of Liability of the Company

The Company is a facilitator and shall not be liable for the following issues arising from the Third Party Operators:

  • Loss or damage to Customer's baggage
  • Different pickup vehicle usage
  • Delays from medical emergencies
  • Late services or failures by the Operator
  • Acts, omissions, or defaults of Operator personnel
  • Force Majeure events
  • Trip cancellations by the Operator
  • Vehicle breakdowns
  • Injuries, illness, or death
  • Deviations in transport or timing
  • Poor service or vehicle condition
  • Overbooking or denied entries at pilgrimages or hotels
  • Failure to provide promised services (meals, kits, etc.)
  • Missing licenses or permits by the Operator
  • Operator representative behavior or hygiene
  • Disputes with the Operator
  • Delays due to technical or unforeseen issues
  • Any other damages outside the Company’s control

To the extent permitted by law, the Company’s total liability is limited to the total price paid for the Pilgrim Package.

Accommodation

The Third Party Operator shall provide the accommodation/lodging for the Customer as detailed in the Pilgrim Package and Reservation. Any discrepancies related to ambience, room size, or service issues, including differences from website pictures, must be addressed directly with the Third Party Operator. The Company is not liable for such issues or their resolution.

Bus

Any disputes regarding bus services, including routes, service deficiencies, fares, bus types, timings, baggage loss or damage, trip cancellations, or lack of travel-related information, must be resolved directly by the Customer with the Third Party Operator. The Company assumes no liability for such disputes.

Train

The Third Party Operator will book train tickets based on the Customer’s preferences (e.g., Tatkal, General, Premium). The Company is not responsible for cancellations by the Operator or railway authorities, delays, or service deficiencies (e.g., food, berth quality).

Food and Refreshments

The Third Party Operator may provide food and refreshments as part of the Pilgrim Package. The Company does not guarantee or warrant the quality, hygiene, or nutritional value of such items.

Medical Assistance

The Company, through Third Party Operators, aims to provide basic first aid kits. For immediate medical assistance, Customers must contact the Third Party Operator directly. The Company is not liable for any delays or harm caused due to lack of timely medical help.

Grievance Redressal

For grievances related to the Pilgrim Package, Customers should contact the tour manager or designated contact person of the Third Party Operator listed in the Reservation.

Additionally, Customers may email [email protected] to file a complaint. The Company aims to respond within seven (7) Business Days.

Travel Assistance and Safety

The Company or Third Party Operator will try but cannot guarantee accommodation of all disabilities or difficulties. Customers requiring assistance must be accompanied by a qualified companion who is also a Customer.

Customers with medical histories are responsible for carrying necessary medications or equipment. Customers with chronic conditions are advised to travel only after getting medical clearance. The Company will not be liable for any consequences due to failure to follow this advice.

Covid 19

Since the onset of the Covid 19 pandemic, the Customer shall comply in all material respects and is in compliance with all statutes, rules, or regulations applicable to the Third Party Operator’s business and operation relating to Covid 19. The Customer shall follow the guidelines notified by the concerned Governmental Authority and/or Third Party Operator. In the event of virus spread, the Third Party Operator may enforce additional guidelines including, but not limited to, wearing masks, maintaining social distancing, carrying test reports, and/or refusing admission of infected Customers.

Confidentiality

The Customer may be given access to Confidential Information under this Agreement. The Customer shall hold such Confidential Information in confidence and not disclose it to any third party or use it for any purpose other than fulfilling the terms of the Agreement.

Termination

Without affecting any other right or remedy available to it, the Company may terminate this Agreement with immediate effect by giving written notice to the Customer, if the Customer fails to provide necessary information or if the information provided is considered unusual or suspicious.

Consequences of Termination

Any provisions of this Agreement intended to continue in effect after termination shall remain in force. Termination shall not affect accrued rights, remedies, or liabilities up to the date of termination, including the right to claim damages for any pre-termination breach.

Indemnity

To the maximum extent permitted by Applicable Law, the Customer agrees to release, defend, indemnify, and hold the Company (including its Representatives) harmless from any claims, liabilities, damages, losses, and expenses, including legal and consulting fees, arising out of or related to:

  • The Customer’s breach of this Agreement or related terms;
  • The Customer’s improper or illegal use of the Services or Website;
  • Interactions with the Third Party Operator, including any damages or injuries during or after the Pilgrim Package; or
  • The Customer’s breach of Applicable Law.

Amendment or Modification

The Company may revise this Agreement at its sole discretion and will endeavor to notify the Customer of proposed changes by email within a reasonable period.

Force Majeure

The Company shall not be liable if it is unable to perform its obligations due to a Force Majeure Event, including but not limited to natural disasters, wars, pandemics, or government actions.

Assignment and Sub Contracting

The Company may assign, transfer, subcontract, or otherwise deal with any of its rights or obligations under this Agreement at any time.

No Partnership or Agency

Nothing in this Agreement shall be deemed to establish a partnership, joint venture, or agency relationship between the parties, nor authorize either party to act on behalf of the other.

Governing Law

This Agreement and any dispute or claim arising out of or in connection with it or its subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of India.

Jurisdiction

Each party irrevocably agrees that the courts of Hyderabad, India shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with this Agreement or its subject matter or formation (including non-contractual disputes or claims).

Entirety

This Agreement along with the documents, records, and policies referred to or incorporated in it shall constitute the entire agreement between the Company and the Customer, and shall supersede all former communications, arrangements, understandings, or agreements, whether written or oral.

Waiver and Severability

Any failure by the Company to enforce any right or provision of this Agreement shall not be deemed a waiver of such right or provision. If any provision of this Agreement is held to be invalid or unenforceable, such provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Language

This Agreement is executed in English only. The Company may provide translations in regional languages for the Customer's convenience. In case of any discrepancy between the English version and regional translations, the English version shall prevail. The Company shall not be liable for any discrepancies in regional language versions.

Survival

The Customer’s representations, undertakings, and warranties, along with clauses related to indemnity, limitation of liability, and governing law, shall survive the expiration or termination of this Agreement.
